Last week, EPA announced its final rule designating PFOA and PFOS as hazardous substances under CERCLA. Along with the final rule announcement was a memorandum that the agency intends to target industrial polluters, not water and wastewater systems with this rule.

This does not provide actual legal protections, however, so Congress has introduced a bill to codify an exemption for utilities, provided there is no "gross negligence," which will create those protections.

The ruling aims at holding polluters accountable rather than water utilities and their customers.
