Recently, a Fort Wright, Ky. developer filed suit against Sanitation District No. 1 of northern Kentucky to force it to refund $9 million in stormwater surcharges it has collected for storm sewer service in the past 18 months.
The litigation, field earlier this in Boone County (Ky.) Circuit Court, has prompted the agency to stop work on stormwater construction projects and could cost local taxpayers if their cities and counties are forced to individually meet federal mandates for stormwater management, warned a sanitation district official.
Class-action status is being pursued so that they can include as plaintiffs all residential and commercial property owners who pay the surcharge.
The sanitation district provides sanitary sewer and storm water services to most of Northern Kentucky, according to officials.
The district began began collecting the fee in Kenton, Campbell and parts of Boone County in August 2003, officials said.
